Terms of Service

Welcome to Linka Technologies, Inc. (“Linka,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, software, AI agents, affiliate tools, analytics dashboards, and related products and services (collectively, the “Services”).

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you:

• Are legally capable of entering into a binding agreement
• Will provide accurate and complete registration information
• Will comply with all applicable laws

2. Account Registration

To use certain features, you must create an account and provide accurate information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use

Linka reserves the right to suspend or terminate accounts containing false, misleading, or incomplete information.

3. Description of Services

Linka provides tools including but not limited to:

• AI-powered agents that answer questions, provide recommendations, and share links
• Affiliate link tools for monetization
• Analytics dashboards for insights, click tracking, and performance metrics
• Integrations with third-party systems such as affiliate networks, CMS platforms, and social media services (e.g., Facebook & Instagram)

The specific capabilities of your AI agent depend on the content you upload and the integrations you enable.

4. User Content and Knowledge Base

You may upload text, documents, videos, links, product catalogs, and other materials (“User Content”) to train and customize your AI agent.

a. Ownership

You retain all rights to your User Content. By using the Services, you grant Linka a limited, non-exclusive, worldwide license to:

• Store and process your content
• Use it to operate and improve your AI agent
• Display or share it through the agent when serving your customers

We do not claim ownership over your content.

b. Your Responsibilities

You agree that:

• You have all necessary rights to upload and use User Content
• Your content does not violate any copyright or trademark rights
• Your content does not contain sensitive personal information (PHI, SSN, financial credentials, etc.)
• You will not upload unlawful, defamatory, or harmful materials

Linka may remove content that violates these Terms.

c. AI Training and Use

Your content trains your AI agent. We do not use your proprietary knowledge base to train global models or other users’ agents.

5. Prohibited Conduct

You may not use the Services to:

• Impersonate any person or organization
• Train agents to mimic or represent third parties without authorization
• Upload copyrighted or trademarked content without rights
• Upload sensitive, regulated, or illegal content
• Reverse engineer, test vulnerabilities, or interfere with the platform
• Use automated tools to scrape or extract data
• Build competing AI or link-tracking systems using Linka data or interfaces
• Misuse Meta Platform Data or violate Meta’s Developer Policies

Violations may result in account suspension or termination.

6. Integrations with Facebook, Instagram, and Meta Platforms

If you connect your Meta accounts, you agree to comply with Meta Platform Terms, Meta Developer Policies, and Meta Data Use Restrictions.

Linka's Commitments

• We only request the minimum permissions needed.
• We only use Meta data for the specific feature you authorize.
• We do not sell or share Meta data with third parties.
• We do not use Meta data to train global AI models.
• We delete Meta data upon request or disconnection.

Your Commitments

You agree that you will not:

• Use Meta data obtained through Linka for unauthorized purposes
• Attempt to identify individuals from Meta data
• Transfer Meta data outside of your authorized systems
• Use the Services to violate Meta’s policies

Failure to comply may result in removal of Meta integrations or termination of your account.

7. Third-Party Services

Linka may integrate with third-party platforms (e.g., affiliate networks, e-commerce systems, CRMs, Meta/Facebook APIs). You acknowledge that:

• Linka is not responsible for third-party availability, data accuracy, or actions
• Your use of third-party services is governed by their respective terms
• Linka may share data with third-party services only when you explicitly connect them

8. Payment Terms

Certain features require payment. By subscribing, you agree to:

• Pay all fees associated with your plan
• Allow recurring charges unless canceled
• Provide accurate billing information

Fees are non-refundable unless required by law. We may change pricing with reasonable notice.

9. Termination

You may stop using the Services at any time.

Linka may suspend or terminate your account if you violate these Terms, misuse integrations or data, or fail to pay subscription fees.

Upon termination, your access is revoked. We may retain certain data as allowed by law. You may request deletion of your data.

10. Intellectual Property

All software, interfaces, designs, features, trademarks, and branding elements are owned by Linka and protected by intellectual property laws.

You may not:

• Copy, modify, or distribute our software
• Build derivative products
• Use our trademarks without permission

11. Disclaimers

The Services are provided “as is” and “as available.” Linka does not guarantee:

• Error-free or uninterrupted operation
• Accuracy of AI responses
• Earnings or performance from affiliate links
• Compatibility with all devices or platforms

Your use is at your own risk.

12. Limitation of Liability

To the maximum extent allowed by law, Linka is not liable for indirect, incidental, punitive, or consequential damages. Linka’s total liability will not exceed the amount you paid in the previous 12 months.

We are not liable for losses arising from inaccurate AI outputs, reliance on recommendations, or failures of third-party services.

13. Indemnification

You agree to indemnify, defend, and hold harmless Linka from any claims, damages, or liabilities arising from:

• Your content
• Your use of the Services
• Violations of these Terms
• Violations of third-party rights
• Misuse of Meta Platform Data

14. Privacy

Our use of personal information is governed by our Privacy Policy, available at /privacy-policy.

15. Data Deletion

You may request deletion of your data at any time by contacting support@linka.ai.

16. Governing Law

These Terms are governed by the laws of the State of New York, USA. Disputes will be handled exclusively in the courts of this jurisdiction.

17. Changes to These Terms

We may update these Terms periodically. Updated versions will include a new “Last Updated” date. Continued use of the Services constitutes acceptance of the updated Terms.
